Liability

The content of the ELFCAM website has been created to the best of its knowledge and belief and was verified at the time this document was drafted. ELFCAM asks you to understand that the function, currency, correctness, completeness or quality of the information (our own as well as that of other authors) cannot be guaranteed.

ELFCAM assumes liability for the company and its vicarious agents — without having agreed the amount of damages — in the event of a breach of fundamental contractual obligations or common commercial practices. In such cases, liability shall be limited to the typical foreseeable damages. There is no liability for any loss of profits or damages resulting from third-party claims against the customer.

ELFCAM shall not be liable, beyond the delivery obligation, for slight negligence on the part of its vicarious agents.

ELFCAM’s liability for its own intentional and grossly negligent conduct and that of its vicarious agents, as well as obligations under product liability law, shall not be affected by the above liability limitations. Liability for slight negligence shall be excluded.

ELFCAM employees who act as performing representatives of ELFCAM towards the customer are not personally liable to the customer in the event of slight negligence.

ELFCAM and its legal representatives are not affected by damages caused by injury to the person, body or health.

Contractual Party, Conclusion of the Contract

The sale contract is concluded with ELFCAM SARL.

By placing an order on our website, we make a binding offer to conclude the purchase contract for these items.

You can add our products to the cart without obligation and correct your entries at any time before sending your order, using the aids and indicators provided in the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the cart. After sending the order, you will immediately receive a confirmation email.

You can correct order information when it has not yet entered the shipping process by informing your account manager in writing in advance. However, orders containing personalised items or items under other special conditions cannot be modified once they have reached « processing » status.

If your order has to be shipped by an ELFCAM affiliate due to insufficient stock at ELFCAM SARL or for other reasons, the contractual party on our side under these terms will automatically be changed to the relevant ELFCAM affiliate, the actual shipper and invoice issuer. You can contact your account manager for detailed arrangements.

Delivery Conditions

ELFCAM offers delivery options such as FedEx, DHL, Chronopost and Colissimo. Please note that orders qualifying for Free Delivery are shipped via Chronopost or Colissimo within French territory. If the customer needs to change the delivery address or method, the customer must pay any additional fees. For more information, you can visit the payment or delivery policy page.

Goods damaged in transit must be reported by the customer to the seller. And if a delay is caused by the logistics company, please inform your account manager as soon as possible.

We can guide you through the repair procedure. But ELFCAM will not be liable for any losses. So that each customer receives their items as quickly as possible, your order may be shipped in multiple parcels at no additional cost from ELFCAM.

For air or sea transport, customers must be informed if the goods are to be collected at the airport or port. If customers can collect the goods at the airport or sea port, it is necessary to know which documents to prepare and which fees to pay. If customers cannot collect the goods, the home delivery service and fees must be negotiated in advance with the account managers.

Reservation of Title

Every item delivered remains the property of ELFCAM until full payment has been received. For entrepreneurs, the following provisions additionally apply:

We reserve title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods under reservation of title in the ordinary course of business; all receivables resulting from such resale are assigned to us in advance — regardless of any combination or mixing of the goods under reservation of title with a new item — up to the invoice amount, and we accept this assignment. You remain entitled to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations.

Intellectual Property Rights and Confidentiality

If a third party should assert rights against the customer for infringement of industrial property rights or copyrights relating to the delivered products, the customer is obliged to notify ELFCAM immediately. Where applicable, with the customer’s support, ELFCAM shall have the right, but at its own expense, to conduct all negotiations with a view to a settlement or any resulting legal proceedings.

If the products supplied have been built according to the customer’s design or instructions, the customer shall indemnify ELFCAM against any claims, liabilities, charges and expenses invoked by third parties due to infringement of patents, trademarks or designs. A reasonable advance on legal proceedings costs shall be granted to ELFCAM.

ELFCAM is obliged to use any knowledge of trade secrets and information that can be classified as confidential, acquired within the framework of the contractual relationship, only for the implementation of this contract. Both parties must treat all documents and information they receive during the performance of a contract in complete confidentiality and for as long as such documents and information are not generally known.

These obligations shall remain in force after the end of the contract and shall also be imposed on third parties in the event of an authorised transfer of documents and information.

Right of Withdrawal

You have the right to cancel a contract within fourteen days. The cancellation period is fourteen days from the date on which you, or a designated third party other than the carrier, received the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (for example, a letter sent by post, fax or email) about your decision to cancel this contract, together with the reasons for revoking it.

The right of withdrawal does not apply to personalised items in the order or to an individual request. To meet the cancellation deadline, you must send the notification of exercising the right of withdrawal before the deadline expires.

Consequences of Cancellation

If you cancel this contract, the cost of returning the goods will be borne by you. We will reimburse all costs (with the exception of the additional costs resulting from choosing a delivery method other than the free standard delivery we offer) no later than fourteen days from the date on which we receive notification of your revocation of this contract. Unless you agree otherwise, we will use the same payment method that you used in the original transaction for this refund; we may refuse the refund until we have received the returned goods.

You must return the goods to us no later than fourteen days from the date on which you inform us of the cancellation of this contract. The cost of returning the goods will be your responsibility unless your return is due to a mistake on our part (you received an incorrect or defective item). And you may need to pay for any loss in value of the goods, if such loss in value is due to handling not necessary to examine the nature, characteristics and functioning of the goods.

The right of withdrawal does not apply to the following contracts:

  • The supply of goods that have not been prefabricated;
  • where manufacture has been carried out according to your preferences;
  • where your specification is authoritative;
  • contracts that are clearly tailored to your personal needs.

Export and Import Licences

The products and technical know-how supplied by ELFCAM are intended to be used and to remain in the country of delivery agreed with the customer.

Re-export of contractual products — individually or integrated into a system — may require the customer to obtain a licence and must comply with foreign trade regulations of the French Republic and the European Union or the other country of delivery agreed with the customer.

The customer must obtain information on these regulations themselves in accordance with the applicable provisions. Regardless of whether the customer specifies the final destination of the contractual products supplied, the customer is responsible for obtaining all necessary licences from the competent foreign trade authorities before exporting these products.

Any new delivery of contractual products to third parties by the customer, with or without ELFCAM’s knowledge, simultaneously requires the transfer of the conditions of the export licence. The customer is responsible to ELFCAM for compliance with these conditions.

Dispute Resolution
